You agree to provide truthful, complete, and current information when creating an account or placing an order. We are not responsible for delays, failed deliveries, lost packages, or other issues caused by incorrect or incomplete customer information.

We may suspend or terminate accounts at our discretion if we believe the account is being misused, used fraudulently, or used in violation of these Terms.

4. Product Information

We try to provide accurate product descriptions, images, pricing, grading information, release dates, and availability details. However, errors may occur.

We do not guarantee that all product descriptions, images, grades, prices, release dates, availability, or other content on the website will always be accurate, complete, current, or error-free.

Product images may be stock images, publisher images, sample images, mockups, or representative images unless otherwise stated. Final products may vary due to printing, manufacturing, publisher changes, cover treatments, shipping, handling, or production differences.

We reserve the right to correct errors, update product information, limit quantities, cancel orders, or refuse service when allowed by law.

5. Comic Book Grading and Condition

Comic book grading is subjective. Different collectors, dealers, grading companies, and customers may evaluate condition differently.

Unless a specific grade is clearly stated in the listing, raw books are sold as NM 9.4 or better with no guarantee of 9.8 or any other specific grade.

We use reasonable industry standards when reviewing condition, including standards used by Overstreet, CGC, CBCS, and general comic collecting practices. However, we do not guarantee that a raw book will receive any specific grade from CGC, CBCS, or any other grading company.

Printing, bindery, manufacturing, distributor handling, and shipping-related variations are common in comic books. Minor defects may still be consistent with NM 9.4 or better condition, including but not limited to:

  • Small spine ticks
  • Minor non-color-breaking dings
  • 2 to 3 small color-breaking spine ticks
  • Slight corner wear
  • Minor bindery tears
  • White showing along the spine
  • Covers slightly offset from interior pages
  • Minor color rub
  • Small paper wrinkles
  • Slightly wavy paper from printing or production
  • Minor production or manufacturing flaws

Minor manufacturing, printing, bindery, or distributor handling defects are not automatically considered shipping damage.

6. Orders

Placing an order does not guarantee acceptance of the order. An order confirmation email means we received your order, but it does not guarantee that the order has been accepted, processed, fulfilled, or shipped.

We reserve the right to cancel, modify, limit, or refuse any order when allowed by law, including but not limited to cases involving:

  • Pricing errors
  • Product listing errors
  • Inventory shortages
  • Supplier cancellations
  • Publisher allocations
  • Duplicate orders
  • Fraud concerns
  • Payment issues
  • Shipping restrictions
  • Abuse of store policies
  • Incorrect customer information
  • Suspected resale abuse or automated purchasing

If we cancel an order that has already been paid for, we will issue an appropriate refund for the canceled portion of the order.

7. Pricing and Payment

All prices are listed in U.S. dollars unless otherwise stated.

Prices do not include shipping, handling, taxes, duties, customs fees, or other charges unless specifically stated at checkout.

We reserve the right to correct pricing errors. If an item was listed at an incorrect price, we may contact you for approval of the corrected price, cancel the order, or issue a refund where appropriate.

Payment must be successfully processed before an order is fulfilled. We may use third-party payment processors to complete transactions. By placing an order, you agree to provide accurate billing and payment information and authorize the payment processor to charge your selected payment method.

We are not responsible for delays caused by payment holds, failed payments, fraud reviews, bank issues, chargebacks, or payment processor reviews.

8. Sales Tax

Sales tax may be charged where required by law. The amount of tax charged may depend on the shipping destination, product type, applicable tax rules, and marketplace or payment processor settings.

You are responsible for any taxes, duties, customs fees, import charges, or similar costs that apply to your order.

9. Presales and Preorders

Items sold before their official release date are considered presale or preorder items.

Presale and preorder items are ordered based on customer purchases. When you place a presale or preorder, we may secure or pay for those items in advance specifically for your order. Because of this, presale and preorder items are final sale and are not eligible for cancellation, return, or refund unless the item is damaged, missing, unavailable, or otherwise required by law.

Presale and preorder items include, but are not limited to:

  • Presale comic books
  • Preorder comic books
  • Ratio variants
  • Incentive variants
  • Signed preorder items
  • CGC preorder items
  • CBCS preorder items
  • Items involving signings, grading, or special handling

Release dates are estimates and may change. Delays may occur due to publishers, distributors, printers, suppliers, signing events, grading companies, shipping carriers, weather, allocation, production issues, or other circumstances outside our control.

If a presale or preorder item is delayed, we will continue to fulfill the order once the item becomes available, unless otherwise required by law.

In rare cases, publishers, distributors, or suppliers may allocate, cancel, short, damage, or fail to provide ordered items. If we cannot fulfill an item, we may offer a replacement, store credit, or refund for the unavailable item.

10. Ratio Variants and Limited Items

Ratio variants, incentive variants, limited covers, exclusives, signed books, graded items, and other limited products may be difficult or impossible to replace.

Orders for ratio variants and limited items may be subject to publisher allocation, distributor shortage, supplier error, damage, cancellation, or availability issues.

We reserve the right to limit quantities, cancel duplicate orders, cancel orders affected by allocation, or refund unavailable items when necessary.

Unless otherwise stated, ratio variants, incentive variants, signed items, graded items, and presale limited items are final sale.

11. In-Stock Items

In-stock items generally ship when the order is ready to be processed and fulfilled.

Cancellations are not accepted on in-stock items once an order is placed, unless otherwise required by law or approved by us.

If an order contains both in-stock and presale items, the in-stock items may be held until all items in the order are available. Customers who want available items shipped separately may be responsible for additional shipping charges.

12. Combined Shipping

If you select combined shipping, your items may be held and shipped together.

Combined shipping orders must meet the posted free-shipping minimum to qualify for free shipping. The current minimum purchase amount for free shipping is $75.

If your combined shipping order total is under $75, you will be charged for shipping.

Orders using combined shipping are not eligible for cancellation or refund simply because they do not qualify for free shipping, because presale items are delayed, or because the customer no longer wants to wait for items to be combined.

Please review our Shipping Policy before selecting combined shipping.

13. Shipping

Shipping times, delivery dates, and release dates are estimates only and are not guaranteed.

We are not responsible for delays caused by:

  • Publishers
  • Distributors
  • Suppliers
  • Printers
  • Signing events
  • Grading companies
  • Shipping carriers
  • Weather
  • Holidays
  • Incorrect customer information
  • Customs processing
  • Carrier misrouting
  • Force majeure events
  • Events outside our reasonable control

Customers are responsible for entering a complete and accurate shipping address at checkout. We are not responsible for orders shipped to an incorrect, incomplete, outdated, or undeliverable address provided by the customer.

If an order is returned to us due to an incorrect address, failed delivery, refusal, or non-pickup, the customer may be responsible for additional shipping charges before the order is reshipped.

14. Risk of Loss

All items purchased for shipment are made pursuant to a shipment contract. This means that risk of loss may pass to the customer once the order is delivered to the shipping carrier, to the extent permitted by law.

We will assist customers with reasonable shipping issues when possible, but we are not responsible for carrier delays, carrier mistakes, theft after delivery, porch piracy, incorrect delivery scans, or packages marked delivered by the carrier.

If a package is marked delivered but you did not receive it, please contact the carrier, check with household members or neighbors, and contact us by email so we can review the situation.

15. Damaged, Missing, or Incorrect Items

Please inspect your order when it arrives.

Damage, missing-item, or incorrect-item claims must be reported by email within 7 days of delivery.

Please include:

  • Order number
  • Full name
  • Email address used at checkout
  • Description of the issue
  • Photos of the item
  • Photos of the packaging
  • Photos of the shipping label
  • Photos of any visible damage to the box or mailer

We may deny claims that are incomplete, submitted late, lack required photos, involve discarded packaging, or cannot be reasonably verified.

When applicable, we may offer a refund, replacement, exchange, or other resolution depending on the issue and available inventory.

16. Returns, Refunds, and Cancellations

Our Returns and Refunds Policy is incorporated into these Terms.

Approved refunds are issued to the original payment method used at checkout. Refunds cannot be sent to a different account, different card, different PayPal account, or alternate payment method.

Approved refunds are usually processed within 5 business days, but your bank, card issuer, or payment provider may take additional time to post the funds.

We do not accept returns, refunds, exchanges, or cancellations for final-sale items, accurately described items, presale items, preorder items, ratio variants, incentive variants, signed items, graded items, or in-stock items except where approved by us or required by law.

17. Chargebacks and Payment Disputes

Please contact us before opening a payment dispute, claim, or chargeback so we have the opportunity to review and resolve the issue.

We may use order records, payment records, tracking information, delivery confirmation, customer communications, product listings, photos, and policy records to respond to chargebacks, disputes, fraud claims, and payment processor inquiries.

Opening a false or improper dispute may result in order cancellation, account restriction, refusal of future service, or other action allowed by law.

18. Promotions, Discounts, and Store Credit

Promotions, discounts, coupon codes, free-shipping offers, rewards, and store credits may be subject to additional terms, expiration dates, exclusions, or limitations.

We reserve the right to modify, suspend, cancel, or refuse promotions or discounts if we believe they are being misused, applied incorrectly, or affected by technical error.

Unless otherwise stated, discounts cannot be applied retroactively to previous orders.

19. User Content, Reviews, and Communications

If you submit reviews, comments, photos, feedback, messages, suggestions, or other content to us or through our website, you grant us permission to use, display, reproduce, modify, publish, or share that content for business purposes, including customer service, marketing, fraud prevention, dispute resolution, and website operation.

  • Shipping or release dates will be exact
  • A raw comic will receive a specific grade
  • A product will meet every customer’s subjective expectations

Some jurisdictions do not allow certain disclaimers, so some of these limitations may not apply to you.

23. Limitation of Liability

To the fullest extent permitted by law, Bidding Bandicoot will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages arising from your use of the website, purchase of products, shipping delays, product availability, presale delays, grading differences, carrier issues, website errors, or third-party services.

To the fullest extent permitted by law, our total liability for any claim related to an order will not exceed the amount you paid for the specific item or order giving rise to the claim.

Nothing in these Terms limits liability where such limitation is prohibited by law.

26. Governing Law

These Terms and your use of our website are governed by the laws of the State of North Carolina, without regard to conflict-of-law principles.

By using our website or placing an order, you agree that North Carolina law applies to these Terms and to disputes involving Bidding Bandicoot, except where prohibited by law.

27. Dispute Resolution

Please provide your name, order number, contact information, and a description of the issue. We will make a reasonable effort to review and resolve the issue informally.

If a dispute cannot be resolved informally, disputes may be handled in the courts or other legally available forums located in North Carolina, unless applicable law requires otherwise.

I’m not adding a strong mandatory arbitration clause here because arbitration clauses can be enforceable in North Carolina, but they should be drafted carefully for consumer transactions. North Carolina’s statutes include a Revised Uniform Arbitration Act framework, and consumer arbitration language is an area where a lawyer should review the exact wording before you publish it.

28. Time Limit for Claims

Except where prohibited by law, any claim or dispute relating to your use of the website, your order, or these Terms must be brought within one year after the claim arises.

Claims not brought within that time may be barred.
